Renting a Room in Lisbon: Contracts, Deposits and Your Rights

Rooms in shared flats are leases under the Civil Code, not informal favors. What the contract must say, the caps on deposits, subletting consent and how to avoid scams.

Renting a room in Lisbon is a lease of part of a home, so the Civil Code’s rental rules apply: the contract must be in writing, the deposit can be at most two months’ rent, and advance rent is capped at two months. If the person renting you the room is a tenant, they need the owner’s written consent to sublet.

The landlord must also report the contract to the tax authority, which lets you claim part of your rent against IRS. Rules below are as of November 2026, from the Civil Code (Código Civil) and the Portal das Finanças; they are general information, and a lawyer (advogado) or a tenants’ association can advise on a dispute.

What should a room rental contract include?

A room contract (contrato de arrendamento de quarto, also called a lease of part of a property) must be written and signed by both sides, under article 1069 of the Civil Code. If the landlord refuses to put it in writing, you can still prove the lease by showing that you lived there without objection and paid monthly rent for six months.

Ask for the contract to cover at least:

  • the names and tax numbers (NIF) of both parties, and the address of the flat;
  • which room is yours and which parts are shared, such as the kitchen, bathroom and living room;
  • the rent, when and how it is paid, and what it includes;
  • how bills are split (electricity, gas, water, internet) and whether there is a monthly cap;
  • the start date, the term and the notice either side must give;
  • the deposit amount and when it is returned;
  • house rules on guests, cleaning and quiet hours.

Get an inventory of the furniture and photos of the room on the day you move in. Our guide to renting an apartment in Lisbon covers leases, viewings and documents in more detail.

How much can a landlord ask as a deposit?

At most two months’ rent as a deposit, and at most two months of rent paid in advance, under article 1076 of the Civil Code. Advance rent needs a written agreement.

Item (as of November 2026) Legal limit Civil Code
Deposit (caução) Up to 2 months’ rent Art. 1076(2)
Rent paid in advance Up to 2 months, with written agreement Art. 1076(1)
Rent charged by a tenant who sublets No more than the tenant’s own rent for that share, plus 20%, unless the owner agrees otherwise Art. 1062
Written contract Required Art. 1069

A request for “first month, last month and two months’ deposit” up front goes beyond these limits. Pay by bank transfer and get a receipt for every payment.

Can my landlord’s tenant sublet a room to me?

Only with the owner’s written authorization (article 1088). A tenant may not let anyone else use all or part of the home by sublet, transfer or free loan unless the law allows it or the owner agrees, and once allowed, the tenant must tell the owner within 15 days (article 1038).

A sublet depends on the main lease: if the main lease ends for any reason, your sublease ends with it (article 1089), and an unauthorized sublet gives the owner grounds to act against the tenant. Ask to see the owner’s consent, or the main lease clause that allows subletting, before you pay anything. A sublet only takes effect toward the owner once the owner recognizes it or is told about it (article 1061).

Does the landlord have to register my contract with Finanças?

Yes. Landlords and sublandlords must report residential leases and subleases to the tax authority (AT) by the end of the month after the lease starts, under article 60 of the Stamp Duty Code, and pay stamp duty. If they do not, tenants and subtenants can report the contract themselves through a tenant’s declaration on the Portal das Finanças, introduced by Ordinance 106/2025/1.

A registered contract matters to you for three reasons:

  1. Tax relief. Tenants can deduct 15% of rent on a permanent home from their IRS, up to €900 for 2026 and €1,000 from 2027 (article 78-E of the IRS Code), if the rent is backed by invoices or electronic rent receipts. See our guide to e-Fatura and IRS deductions.
  2. Proof of address. Many offices ask for a lease when you request proof of address from your parish council; see our guide to the atestado de residência.
  3. Your rights. A registered contract is the easiest evidence that you are a tenant, not a guest.

What rights do I have as a room tenant?

You have the same core rights as any residential tenant for the space you rent: the rent agreed in the contract, quiet use of your room and the shared areas listed, repairs to make the home usable, and the notice periods the law sets. The rules on notice, deposits and evictions are explained in our guide to tenant rights in Portugal.

A tenant living in the flat may host up to three paying guests (hóspedes) to whom they provide housing and services, such as meals, unless the lease forbids it (article 1093). Arrangements beyond that are subletting and need the owner’s consent.

How do I spot a room rental scam?

Scams in Lisbon’s room market follow familiar patterns, especially for students and remote workers booking from abroad:

  • The “landlord” is abroad and asks for a deposit before any viewing, often through a money-transfer service or crypto.
  • The price is far below similar rooms in the same area, and the photos appear on other listings.
  • You are pushed to pay today because “many people are interested”.
  • There is no written contract, or the person refuses to show ID or proof they own or lawfully rent the flat.
  • The listing asks you to move off the platform to a private chat or a fake booking site.

View in person or by live video, pay only to a Portuguese bank account in the landlord’s name after signing, and keep every message. If you have been defrauded, report it to the PSP (Portugal’s public security police).

Bottom line

The two-month caps on deposits and advance rent are the quickest way to judge a landlord’s offer, and a sublet without the owner’s written consent is the biggest hidden risk. Ask for both the contract and proof that it was reported to Finanças: it costs the landlord nothing extra if they are already compliant, and it gives you a tax deduction.

FAQ

Can a landlord ask for three months’ deposit for a room?

No. Article 1076 of the Civil Code caps the deposit at two months’ rent, and advance rent at two months with a written agreement.

Are bills included in room rent?

Only if the contract says so. Ask for the split in writing, including any cap, and copies of the bills if you pay a share.

Can I register my address at a rented room?

Usually yes, with the contract and the landlord’s cooperation, since a parish council or Finanças may ask for proof that you live there.

What if the landlord will not register the contract?

Tenants and subtenants can report the contract to Finanças themselves through the tenant’s declaration on the Portal das Finanças.
